Opposition parties mounted a strong campaign against the ruling party and as a result many large councils are now going to struggle with coalitions. Here is an article which explains the way local governments function and what is their role. Clearly if our country has to progress then delivery of services must be the central issue. Will Councils move from personal and power politics to ensuring that municipalities work at optimum levels? Will communities take responsibility to ensure that they play their role in keeping the environment free of pollution and crime and grime?<\/b><\/i><\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\"><b>By Sibusiso Zindela\u00a0 <\/b>(Third year journalism student DUT)<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">Many local authorities in South Africa, including the large metropolitan councils of Nelson Mandela Bay, Johannesburg and Tshwane, will see some form of coalition government for the first time in the country\u2019s history. This is because no single party won an\u00a0<\/span><\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"https:\/\/www.elections.org.za\/LGEDashBoard2016\/\" target=\"_blank\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">outright majority<\/span><\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">\u00a0in the recent\u00a0<\/span><\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"http:\/\/ewn.co.za\/2016\/08\/07\/As-election-dust-settles-ANC-concerned-about-dwindling-support\" target=\"_blank\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">municipal polls<\/span><\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">.<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">After all the formalities voters may well ask: but what will my new municipal council do? And what is its constitutional mandate?<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">South Africa has a\u00a0<\/span><\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"https:\/\/www.nelsonmandela.org\/omalley\/index.php\/site\/q\/03lv02167\/04lv02184\/05lv02193\/06lv02198.htm\" target=\"_blank\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">three-sphere system<\/span><\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">\u00a0of government &#8211; national, provincial and local. Each has specific functional responsibilities. Typical local government functions include providing water and sanitation services.<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">Typical provincial functions include school education and health care. The national government is responsible for competencies like policing and national defence. The three spheres must interact in a spirit of\u00a0<\/span><\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"http:\/\/www.justice.gov.za\/legislation\/constitution\/SAConstitution-web-eng-03.pdf\" target=\"_blank\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">co-operative government<\/span><\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">. This is required by the constitution.<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">Various other countries also have three-tier systems of government. The specific division of functions, and degree of centralisation or decentralisation, depend on each country\u2019s specific circumstances.<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">For example\u00a0<\/span><\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"http:\/\/www.constitution.org\/cons\/india\/const.html\" target=\"_blank\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">India<\/span><\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">, the world\u2019s largest constitutional democracy, has a national government (Union), 28 states (provinces), seven centrally administered territories and a variety of local government structures that includes more than 3 000 large urban areas.<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">Germany has a federal government, 16\u00a0L\u00e4nder\u00a0(provinces) and a variety of local authorities, some of which are quite small. The<\/span><\/span><em><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">\u00a0<\/span><\/span><\/em><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"https:\/\/www.bundestag.de\/htdocs_e\/bundestag\/function\/legislation\/competencies\/245700\" target=\"_blank\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">L\u00e4nder<\/span><\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">\u00a0have the constitutional supervisory authority over local government.<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">South Africa is unique in that its\u00a0<\/span><\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"http:\/\/www.justice.gov.za\/legislation\/constitution\/SAConstitution-web-eng-03.pdf\" target=\"_blank\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">Constitution<\/span><\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">\u00a0is the first to list principles of co-operative government that must guide the way in which each sphere of government must behave and interact with the others. Cooperation in this context means respect for each other\u2019s specific roles, working in a spirit of mutual trust and good faith and loyalty to the constitution and citizens.<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">Many of the country\u2019s municipalities don\u2019t function properly because of insufficient management and\u00a0<\/span><\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"http:\/\/www.cogta.gpg.gov.za\/Strategic%20Documents\/Back%20to%20Basics%20Perspective.pdf\" target=\"_blank\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">administrative capacity<\/span><\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">. They don\u2019t have enough appropriately qualified and experienced staff.<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">This inevitably leads to poor delivery of municipal services and infrastructure maintenance. It also hampers development. In addition, the quality of financial management in many municipalities is simply not at an\u00a0<\/span><\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"http:\/\/www.agsa.co.za\/Documents\/Auditreports\/MFMA20142015.aspx\" target=\"_blank\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">acceptable level<\/span><\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">. The new local councils face huge challenges in building capable and successful local authorities.<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">The voters have clearly expressed their views about the performance of municipal councils. But they should not show their concerns only once every five years, but during an elected council\u2019s whole period in office.<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">Municipal councillors\u2019 mandates are naturally directed by their political party philosophy and specific policies. But there is an overarching mandate for all local authorities, namely the constitutional mandate.<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">Local government is the only sphere of South African government for which the country\u2019s <\/span><\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"http:\/\/www.gov.za\/documents\/constitution\/Constitution-Republic-South-Africa-1996-1\" target=\"_blank\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">Constitution<\/span><\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">\u00a0stipulates a specific mandate. It gives local authorities a basic framework of objectives.\u00a0<\/span><\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"http:\/\/www.justice.gov.za\/legislation\/constitution\/SAConstitution-web-eng-07.pdf\" target=\"_blank\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">Section 152<\/span><\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">\u00a0stipulates that local government must:<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">&#8211; provide democratic and accountable government for local communities;<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">&#8211; ensure the provision of services to communities in a sustainable manner;<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">&#8211; promote social and economic development;<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">&#8211; promote a safe and healthy environment; and<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">&#8211; encourage the involvement of communities and community organisations in the matters of local government.<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">Municipalities are mandated to achieve these objectives within their financial and administrative capacity.<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">These five objectives are not hollow words on paper and written for lawyers or academics to analyse. They provide a very clear framework of governance for all local authorities and must be translated into practice. They provide a sound basis for good governance; the ideal that all government institutions should strive for.<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><strong><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">Service delivery and accountability<\/span><\/span><\/strong><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">All municipalities must have a strategic plan called the integrated development plan\u00a0<\/span><\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"http:\/\/www.energy.gov.za\/files\/policies\/act_municipalsystem_32of2000.pdf\" target=\"_blank\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">(IDP)<\/span><\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">. This should be the road map for a newly elected council to achieve the constitutional objectives. The plans, as well as the annual budgets, should provide clear information about the \u201cprovision of services to communities\u201d.<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">Voters will monitor whether the municipal services &#8211; such as water, electricity and roads &#8211; are provided in a sustainable manner. But a municipal council should ensure in its planning that sustainability of service delivery is properly attended to.<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">The integrated development plan should also spell out what the council will do to \u201cpromote social and economic development\u201d. It should also state how it will \u201cpromote a safe and healthy environment\u201d. Policy choices will be made about the specific ways of achieving the goals set out in the plan. This should be done while taking into account the budget of the specific municipality.<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">Informing the citizens in a local community about the municipal council\u2019s plans is an important basic step in promoting accountability. But it is not enough. Accountability also requires regular reporting, within a municipal council, to the provincial government, to the\u00a0<\/span><\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"http:\/\/www.agsa.co.za\/\" target=\"_blank\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">Auditor-General<\/span><\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">\u00a0and to the citizens.<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">It also means that when public funds are mismanaged or the\u00a0<\/span><\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"http:\/\/www.gov.za\/documents\/local-government-municipal-finance-management-act-0\" target=\"_blank\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">Municipal Finance Management Act<\/span><\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">\u00a0is contravened in other ways, the correct steps must be taken to hold the respective officials or councillors accountable.<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">The fifth element of the constitutional mandate for municipal councils is \u201cto encourage the involvement of communities and community organisations in the matters of\u00a0<\/span><\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"http:\/\/www.gov.za\/documents\/constitution\/Constitution-Republic-South-Africa-1996-1\" target=\"_blank\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">local government<\/span><\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">\u201d.<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><strong><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">Involving communities<\/span><\/span><\/strong><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">There are many ways to achieve this goal. Some are required by law. For example, a council must publish an annual budget plus an integrated development plan. It must also invite the members of the local community to comment on them. There are also other ways of involving communities which municipalities should actively explore.<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">It is crucial that citizens be involved in creating the future they want. Protests in local communities are sometimes motivated by a frustration that their voices are\u00a0<\/span><\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"http:\/\/mg.co.za\/article\/2016-05-19-00-violent-protests-are-a-symptom-of-people-being-ignored-by-politicians\" target=\"_blank\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">not heard<\/span><\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">.<\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-ZA\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">The poor situation of most municipal councils described by the Department of Cooperative Government and Traditional Affairs in\u00a0<\/span><\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"http:\/\/www.cogta.gpg.gov.za\/Strategic%20Documents\/Back%20to%20Basics%20Perspective.pdf\" target=\"_blank\"><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\">2014<\/span><\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Arial Unicode MS,sans-serif;\"><span style=\"font-size: small;\"> was a harsh wake-up call. It showed that much still needed to be done to achieve the goals set out for municipalities in the Constitution. The newly elected councils, which will have many new councillors, are in a good position to start afresh.
